Medical Leave: Rights for Ontario Employees

Yes. Ontario employees who meet the legal requirements are entitled to take a job-protected medical leave when they are unable to work due to illness, injury, or a medical condition. This applies whether the condition is physical or mental and whether it arises suddenly or develops over time.

In most cases, no. If you meet the requirements for medical leave, your employer cannot refuse the leave or penalize you for taking it. The employer’s role is to manage the workplace impact, not to assess whether your medical need is legitimate.

Employers are generally entitled to confirmation that you are medically unable to work and, in some cases, an expected duration or functional limitations. You are not required to disclose your diagnosis or detailed medical history. This applies throughout the medical leave process.

Limited, reasonable contact is sometimes appropriate, such as asking about return-to-work timing. However, repeated pressure, intrusive questions, or requests that undermine the purpose of the leave may be legally problematic. The focus should remain on your recovery.

Termination during medical leave is not automatically illegal, but termination because of medical leave or disability may violate employment or human rights laws. Each situation depends on timing, employer conduct, and the stated reasons for termination.

Pressure to return early, threats to job security, or ignoring medical restrictions may violate legal obligations. Employees are generally entitled to recover before resuming work, based on medical advice.
